Cancellation & Refund Policy
This Cancellation & Refund Policy governs all bookings, deposits, and course payments made for training courses provided by UTN College (trading as Under the Needle College). It sets out your statutory rights, cooling-off provisions, non-refundable deposit terms, and the procedures for voluntary cancellations or deferrals.
Nothing in this policy limits or affects your statutory rights under the Consumer Contracts Regulations 2013 or the Consumer Rights Act 2015. Students are encouraged to read this policy alongside our complete Terms & Conditions.
1. Statutory Cooling-Off Period (14 Days)
1.1. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, students booking a training course online or at a distance have a statutory right to cancel within a 14-day cooling-off window.
1.2. The 14-day statutory cancellation period begins on the day the booking agreement is entered into (i.e., upon confirmation of deposit payment).
1.3. Within this statutory period, you are entitled to cancel your enrolment without giving any reason and receive a full refund of all payments made, subject to clause 1.4 below.
1.4. Where you expressly request that your training course begins during the 14-day statutory cancellation period, you acknowledge that the College will deliver training services before the cooling-off period expires. If you subsequently cancel within the cooling-off window, the College is entitled to deduct an amount in proportion to the training services delivered up to the point of cancellation.
1.5. The College will provide legally required cancellation information and a model cancellation form before an eligible online booking is completed.
2. Course Fees & Booking Deposit Policy
2.1. The total course fee for the UTN College Three-Month Professional Tattoo Training Programme is £3,599.
2.2. A booking deposit of £599 must be paid to secure a place on your selected course intake. This deposit is credited towards the total course fee.
2.3. Because class sizes are strictly capped to maintain individual instructor supervision, hygiene compliance, and dedicated workstation allocation, the deposit secures a limited-capacity training place.
2.4. Subject to statutory cancellation and refund rights, the £599 deposit is intended to be non-refundable where a student cancels voluntarily or changes their mind after the 14-day statutory period has elapsed, reflecting genuine administrative and preparation costs incurred by the College.
2.5. The College may retain up to the deposit amount where justified by genuine losses, unavoidable preparation costs, and any reasonable opportunity to fill the vacated place.
2.6. The deposit will not automatically be forfeited where retaining it would be unfair or contrary to applicable UK consumer law.
3. Remaining Balance Deadlines & Non-Payment
3.1. The remaining balance of £3,000 must be paid in full no later than seven (7) calendar days before the scheduled course start date.
3.2. Payment reminders are scheduled as follows:
- First Reminder: Sent approximately 14 calendar days before course commencement.
- Second Reminder: Sent 7 calendar days before commencement if balance remains outstanding.
3.3. Students remain responsible for completing payment by the deadline regardless of reminder receipt.
3.4. Failure to pay the outstanding balance by the deadline may result in a final payment notice. If the balance remains unpaid following this notice, the College may cancel the enrolment and release the workstation to another applicant on the waiting list.
3.5. Under no circumstances is a student permitted to attend practical training or take up studio equipment while any portion of the course fee remains outstanding, unless expressly confirmed in writing by the College.
4. Third-Party Financing & PayPal Pay in 3
4.1. Where available, eligible students may apply to use PayPal Pay in 3 to finance the £3,000 outstanding balance in three monthly instalments of £1,000.
4.2. PayPal Pay in 3 is a third-party credit/financing facility provided by PayPal (Europe) S.à r.l. et Cie, S.C.A. Approval is subject to PayPal’s independent credit criteria and terms.
4.3. UTN College is not a credit broker and is not responsible for the approval or rejection of third-party financing applications.
4.4. Students choosing PayPal Pay in 3 must complete the checkout transaction prior to the College’s 7-day payment deadline.
4.5. Any refunds for transactions completed through PayPal or other third-party services will be processed in accordance with PayPal’s refund framework and applicable consumer regulations.
5. Voluntary Cancellation Outside Statutory Period
5.1. Following expiry of the 14-day statutory cooling-off period, a student who voluntarily cancels their enrolment may be responsible for genuine and reasonable losses incurred by the College as a direct result of the cancellation.
5.2. In calculating cancellation charges, the College will take into account:
- Unavoidable preparation costs, kit orders, and workstation provisioning.
- Operational expenses and instructor scheduling commitments.
- Any expenses saved by the College as a result of the cancellation.
- Reasonable opportunities and time available to fill the vacated place with an alternative applicant.
5.3. Where the £3,000 balance has already been paid and the cancellation occurs with sufficient advance notice allowing the place to be filled, the College will refund the balance less any genuine and evidenced administrative costs.
6. Student Withdrawal After Course Commencement
6.1. Once the training programme has commenced on the scheduled start date, withdrawal by a student does not automatically entitle the student to a refund.
6.2. Because a vacated training workstation cannot readily be filled once the curriculum has commenced, the College may retain course fees proportionate to the training delivered, the reserved capacity, and unavoidable operational commitments.
6.3. All requests for mid-programme withdrawal will be reviewed fairly in accordance with UK consumer law principles and the specific circumstances of the case.
7. Illness, Bereavement & Compassionate Grounds
7.1. The College recognizes that unexpected and severe personal crises may occur. Where certified serious illness, bereavement, or exceptional compassionate circumstances prevent a student from attending or completing the programme, the College will consider supportive options.
7.2. At its discretion, the College may offer:
- A fee-free or subsidized transfer to the next available course intake.
- A temporary suspension of studies with guaranteed re-entry.
- Proportionate discretionary refund concessions assessed on individual merits.
7.3. Medical evidence (such as a GP note or medical certificate) or relevant documentation will normally be requested to support exceptional circumstance applications.
8. Course Deferrals & Intake Date Transfers
8.1. Students wishing to defer their training or transfer to a later course intake must submit a formal request in writing to Info@utncollege.co.uk.
8.2. Deferrals and date transfers are subject to place availability on the requested future intake and operational scheduling.
8.3. The College is not obliged to grant voluntary date transfer requests, but will endeavour to accommodate reasonable requests where operational capacity allows.
8.4. Where an agreed transfer involves reasonable additional administrative costs, these will be explained and agreed in writing before the transfer is finalized.
8.5. Your statutory consumer rights remain unaffected by any deferral or transfer request.
9. Course Cancellation or Postponement by UTN College
9.1. UTN College reserves the right to cancel, postpone, or reschedule any course where there are insufficient enrolments or where unforeseen circumstances prevent the course from proceeding as planned.
9.2. In the unlikely event that a scheduled course cannot go ahead, all affected students will be contacted as soon as reasonably possible and offered the following options:
- Full Refund: Receive a full refund of all payments made towards the course, including the booking deposit.
- Transfer to Another Course Date: Transfer their booking and all payments already made to an alternative available course date, subject to availability.
9.3. Where a refund is selected, UTN College will process the refund within 14 calendar days of the student's confirmation.
9.4. UTN College will not be responsible for any additional expenses incurred by students, such as travel, accommodation, or loss of earnings, except where liability cannot legally be excluded.
9.5. Where unavoidable operational changes (e.g. instructor substitution or minor timetable adjustments) occur, they must not materially reduce the contracted training standard or hours.
Important: This clause applies where UTN College cancels or cannot deliver the course. It does not affect the separate terms relating to student-initiated cancellations or non-refundable deposits, nor does it limit students' statutory consumer rights.
